Estos Términos del Servicio ("Términos") rigen su acceso y uso de la plataforma de software, los sitios web y las aplicaciones móviles de Coastly (en conjunto, el "Servicio"). El Servicio es operado por Mangold Holdings, LLC, una sociedad de responsabilidad limitada de California ("Coastly", "nosotros" o "nuestro"). Al crear una cuenta o usar el Servicio, usted acepta estos Términos.
1. Qué es Coastly
Coastly es una plataforma de software y un directorio local para pueblos surfistas. Ofrecemos herramientas que permiten a los negocios ("Vendedores") crear anuncios y llegar a las personas de su pueblo, y que permiten a los residentes y visitantes ("Usuarios") ver información sobre el surf y el pueblo y descubrir negocios locales.
Coastly es un proveedor de software. Coastly no es el vendedor, proveedor ni garante de ningún bien, servicio, experiencia, alquiler, estadía, propiedad, boleto u otra oferta publicada por los Vendedores. Cualquier transacción por los bienes o servicios de un Vendedor es exclusivamente entre el Usuario y ese Vendedor. Coastly no es parte en esas transacciones y no procesa los pagos entre los Usuarios y los Vendedores.
2. Elegibilidad y cuentas
Usted debe tener al menos 18 años para crear una cuenta. Usted es responsable de la información que proporciona, de la actividad en su cuenta y de mantener sus credenciales seguras. Usted se compromete a proporcionar información precisa y a mantenerla actualizada.
Usted puede crear su cuenta o acceder a ella mediante un proveedor de inicio de sesión externo como Google. Cuando lo hace, su uso de ese proveedor también está sujeto a los términos y a la política de privacidad de dicho proveedor, y solo recibimos información básica de perfil (como su nombre, dirección de correo electrónico y foto de perfil) según se describe en nuestra Política de Privacidad.
3. Cuentas de Vendedores y nuestros productos
Los Vendedores pueden usar Coastly de forma gratuita para crear un anuncio básico. Coastly cobra a los Vendedores por lo siguiente, todo facturado por Coastly al Vendedor:
- •Una tarifa de plataforma equivalente al 10% del valor del negocio que Coastly genera para el Vendedor (por ejemplo, pedidos, reservas, lecciones, clases, tours y alquileres iniciados a través del Servicio). Esta tarifa se factura al Vendedor; Coastly no la deduce del pago entre el Vendedor y su cliente, ni lo procesa. Las referencias de estadías son del 5%, y las referencias inmobiliarias son del 15% de la comisión del agente vendedor.
- •Coastly Pro, una suscripción mensual opcional de software con herramientas mejoradas de anuncios y de negocio.
- •Impulsos y ubicaciones destacadas, tarifas opcionales para destacar un anuncio de forma más prominente dentro de la plataforma.
La tarifa de plataforma compensa a Coastly por el software, el marketing y la generación de clientes potenciales que le aportan ese negocio al Vendedor. Coastly no es un procesador de pagos de la transacción subyacente, ni el vendedor en ella; el cliente le paga directamente al Vendedor. Las tarifas se describen en nuestra página de Precios. Durante el período de lanzamiento de cada pueblo, la tarifa de plataforma se exonera para los Vendedores fundadores, y proporcionaremos aviso antes de que comience cualquier cobro. Podemos cambiar nuestras tarifas de forma prospectiva con un aviso razonable.
4. Uso aceptable
Usted se compromete a no hacer un mal uso del Servicio. No publicará contenido ilícito, engañoso, infractor o dañino; no suplantará a otras personas; no extraerá datos ni sobrecargará el Servicio; no intentará acceder a cuentas o datos que no le pertenezcan; ni usará el Servicio para violar cualquier ley aplicable. Podemos eliminar contenido o suspender cuentas que violen estos Términos.
5. Información de surf, marea y clima ("tal cual")
Coastly muestra condiciones de surf, marea, viento, clima y condiciones reportadas por la comunidad, incluidos reportes publicados por capitanes, reporteros y otros Usuarios. Esta información se proporciona únicamente con fines informativos generales, puede ser inexacta, incompleta, tardía o modelada, y no debe utilizarse como base para decisiones de seguridad.
El océano es peligroso. Usted es el único responsable de evaluar las condiciones y su propia capacidad antes de entrar al agua o emprender cualquier actividad. Coastly no ofrece ninguna garantía respecto a la exactitud de ninguna condición, pronóstico, calificación, "mejor ventana" o reporte, y no es responsable de ninguna decisión que usted tome con base en ellos.
Los datos de surf, marea, viento y clima se agregan de proveedores de datos externos, incluidos Stormglass.io, Open-Meteo y NOAA, y siguen estando sujetos a los términos de dichos proveedores y se acreditan donde se muestran. Coastly no es propietario de estos datos y no garantiza su exactitud, integridad ni disponibilidad.
6. Tours, actividades y ofertas de riesgo físico
Los Vendedores pueden anunciar tours, lecciones, chárteres, experiencias, alquileres y otras actividades que conllevan riesgos físicos inherentes. Coastly no organiza, supervisa, inspecciona, asegura ni respalda estas actividades y no es responsable de ellas. Cualquier renuncia, seguro, calificación o disposición de seguridad es entre usted y el Vendedor. Participe bajo su propio riesgo.
7. Contenido que usted publica
Usted conserva la propiedad del contenido que envía (por ejemplo, reseñas, reportes de surf, fotos y videos). Usted le otorga a Coastly una licencia mundial, no exclusiva y libre de regalías para alojar, almacenar, mostrar y distribuir ese contenido dentro del Servicio, con el fin de operarlo y promocionarlo. Usted declara que tiene los derechos sobre el contenido que publica.
8. Descargos de responsabilidad
El Servicio se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, ya sean expresas o implícitas, incluidas las de comerciabilidad, idoneidad para un propósito particular y no infracción. No garantizamos que el Servicio sea ininterrumpido, libre de errores o seguro.
9. Limitación de responsabilidad
En la máxima medida permitida por la ley, Coastly y sus miembros, directivos y agentes no serán responsables de ningún daño indirecto, incidental, especial, consecuente o punitivo, ni por pérdida de ganancias, datos, buena voluntad, ni por ningún asunto que surja de las interacciones con Vendedores u otros Usuarios. Nuestra responsabilidad total por cualquier reclamo relacionado con el Servicio no excederá el mayor de los montos que usted le pagó a Coastly en los doce meses previos al reclamo, o cien dólares estadounidenses. Nada en estos Términos limita ninguna responsabilidad que no pueda limitarse conforme a la ley aplicable, incluida la derivada de dolo, negligencia grave, o muerte o lesiones personales, o sus derechos irrenunciables bajo la ley de protección al consumidor de su país.
10. Indemnización
Usted se compromete a indemnizar y a mantener indemne a Coastly frente a reclamos, daños y gastos que surjan de su uso del Servicio, de su contenido, o de su violación de estos Términos o de la ley aplicable.
11. Terminación
Usted puede dejar de usar el Servicio en cualquier momento. Podemos suspender o terminar el acceso si usted viola estos Términos o si es necesario para proteger el Servicio u otros usuarios. Las secciones que por su naturaleza deban subsistir tras la terminación subsistirán.
12. Ley aplicable, consumidores e idioma
Estos Términos se rigen por las leyes del Estado de California, sin considerar sus normas sobre conflicto de leyes. La jurisdicción exclusiva para las disputas serán los tribunales estatales y federales ubicados en California, y usted consiente su jurisdicción.
Si usted usa el Servicio como consumidor, las leyes imperativas de protección al consumidor de su país de residencia aplican independientemente de esta elección de ley, y nada en estos Términos renuncia a su derecho a la protección de su autoridad local de consumo (por ejemplo, ACODECO en Panamá, o la autoridad equivalente en Costa Rica, México, Colombia y otros países), las cuales prevalecen sobre cualquier término contrario. Coastly es una plataforma de software y no es parte en, ni procesa, el pago entre usted y cualquier Vendedor; los reembolsos y las disputas sobre los bienes o servicios de un Vendedor son con ese Vendedor.
Estos Términos se proporcionan en inglés, con una traducción al español por conveniencia. La versión en inglés prevalece, salvo que, para un consumidor en un país cuya ley exija el idioma local, la versión en español rija en la medida requerida.
13. Cambios en estos Términos
Podemos actualizar estos Términos de vez en cuando. Publicaremos la versión actualizada con una nueva fecha de "Última actualización" y, cuando corresponda, proporcionaremos un aviso adicional. El uso continuado del Servicio después de que los cambios entren en vigor significa que usted acepta los Términos actualizados.

These Terms of Service ("Terms") govern your access to and use of the Coastly software platform, websites, and mobile applications (together, the "Service"). The Service is operated by Mangold Holdings, LLC, a California limited liability company ("Coastly," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. What Coastly is
Coastly is a software platform and local directory for surf towns. We provide tools that let businesses ("Vendors") create listings and reach people in their town, and that let residents and visitors ("Users") view surf and town information and discover local businesses.
Coastly is a software provider. Coastly is not the seller, provider, or guarantor of any goods, services, experiences, rentals, stays, properties, tickets, or other offerings listed by Vendors. Any transaction for a Vendor's goods or services is solely between the User and that Vendor. Coastly is not a party to those transactions and does not process payments between Users and Vendors.
2. Eligibility and accounts
You must be at least 18 years old to create an account. You are responsible for the information you provide, for activity under your account, and for keeping your credentials secure. You agree to provide accurate information and to keep it current.
You may create or access your account using a third-party sign-in provider such as Google. When you do, your use of that provider is also subject to the provider's own terms and privacy policy, and we receive only basic profile information (such as your name, email address, and profile photo) as described in our Privacy Policy.
3. Vendor accounts and our products
Vendors may use Coastly for free to create a basic listing. Coastly charges Vendors for the following, all billed by Coastly to the Vendor:
- •A platform fee equal to 10% of the value of business that Coastly drives to the Vendor (for example, orders, bookings, lessons, classes, tours, and rentals initiated through the Service). This fee is billed to the Vendor; Coastly does not deduct it from, or process, the payment between the Vendor and its customer. Stays referrals are 5%, and real estate referrals are 15% of the selling agent's commission.
- •Coastly Pro, an optional monthly software subscription with enhanced listing and business tools.
- •Boosts and featured placements, optional fees to feature a listing more prominently within the platform.
The platform fee compensates Coastly for the software, marketing, and lead generation that bring the Vendor that business. Coastly is not a payment processor for, and not the seller in, the underlying transaction; the customer pays the Vendor directly. Fees are described on our Pricing page. During each town's launch period the platform fee is waived for founding Vendors, and we will provide notice before any charges begin. We may change our fees on a prospective basis with reasonable notice.
4. Acceptable use
You agree not to misuse the Service. You will not post unlawful, deceptive, infringing, or harmful content; impersonate others; scrape or overload the Service; attempt to access accounts or data that are not yours; or use the Service to violate any applicable law. We may remove content or suspend accounts that violate these Terms.
5. Surf, tide, and weather information ("as is")
Coastly displays surf, tide, wind, weather, and community-reported conditions, including reports posted by captains, reporters, and other Users. This information is provided for general informational purposes only, may be inaccurate, incomplete, delayed, or modeled, and must not be relied upon for safety decisions.
The ocean is dangerous. You are solely responsible for assessing conditions and your own ability before entering the water or undertaking any activity. Coastly makes no warranty regarding the accuracy of any conditions, forecast, rating, "best window," or report, and is not liable for any decision you make based on them.
Surf, tide, wind, and weather data is aggregated from third-party data providers, including Stormglass.io, Open-Meteo, and NOAA, and remains subject to those providers' terms and is credited where shown. Coastly does not own this data and does not guarantee its accuracy, completeness, or availability.
6. Tours, activities, and physical-risk offerings
Vendors may list tours, lessons, charters, experiences, rentals, and other activities that carry inherent physical risks. Coastly does not organize, supervise, inspect, insure, or endorse these activities and is not responsible for them. Any waiver, insurance, qualification, or safety arrangement is between you and the Vendor. Participate at your own risk.
7. Content you post
You retain ownership of content you submit (for example, reviews, surf reports, photos, and videos). You grant Coastly a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content within the Service to operate and promote it. You represent that you have the rights to the content you post.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, Coastly and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or for any matter arising from interactions with Vendors or other Users. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid Coastly in the twelve months before the claim, or one hundred U.S. dollars. Nothing in these Terms limits any liability that cannot be limited under applicable law, including for willful misconduct, gross negligence, or death or personal injury, or your non-waivable rights under the consumer-protection law of your country.
10. Indemnification
You agree to indemnify and hold harmless Coastly from claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination will survive.
12. Governing law, consumers, and language
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in California, and you consent to their jurisdiction.
If you use the Service as a consumer, the mandatory consumer-protection laws of your country of residence apply regardless of this choice of law, and nothing in these Terms waives your right to the protection of your local consumer authority (for example ACODECO in Panama, or the equivalent authority in Costa Rica, Mexico, Colombia, and other countries), which prevail over any conflicting term. Coastly is a software platform and is not a party to, and does not process, the payment between you and any Vendor; refunds and disputes over a Vendor's goods or services are with that Vendor.
These Terms are provided in English, with a Spanish translation for convenience. The English version prevails, except that for a consumer in a country whose law requires the local language, the Spanish version governs to the extent required.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect means you accept the updated Terms.
