Política de Reembolsos y Cancelaciones — Panamá

Qué cubre esta política

Coastly es una plataforma de software. Coastly solo cobra a los Vendedores, y solo estos pagos se cubren aquí:

  • Coastly Pro, nuestra suscripción mensual opcional de software para Vendedores.
  • Ubicaciones destacadas y de promoción compradas por Vendedores.

Qué no se cubre: todo lo que compres a un Vendedor, incluido el alojamiento, comida, tours, alquileres y boletos. Eso lo pagas directamente al Vendedor y Coastly no es el vendedor. Contacta al Vendedor para el reembolso de sus bienes o servicios.

Estadías

Coastly no te cobra nada cuando reservas una estadía. Reservas y pagas al anfitrión, ya sea en su propia página de reservas o directamente con él. Ese dinero nunca llega a Coastly, de modo que Coastly no tiene nada que reembolsar. Los términos de cancelación y reembolso del anfitrión rigen la estadía, y cualquier reembolso corresponde hacerlo a él. A Coastly le paga el anfitrión, con su propio dinero, y nada de lo que Coastly gana se añade a tu precio.

Tus derechos conforme a la ley panameña

Esta política se rige por las leyes de la República de Panamá y no limita ningún derecho que te otorgue la Ley 45 de 2007. Cuando esta política y esa ley difieran, prevalece la ley.

La ley panameña no te da un derecho general de retracto en una reserva en línea. La Ley 45 no contiene un derecho de retracto. Lo decimos con claridad en vez de insinuar un derecho que no existe. Los compromisos anteriores son nuestros, por contrato, y nos obligan.

Lo que sí te da la Ley 45, y no podemos quitarte:

  • El artículo 74 declara absolutamente nula la cláusula de un contrato de adhesión que limite

nuestra responsabilidad por incumplimiento o mora, restrinja tus derechos, te obligue a renunciar anticipadamente a un derecho, implique renuncia a tus acciones procesales, sea ilegible o esté redactada en idioma distinto del español. Nada en esta política pretende hacer eso y, en la medida en que algo lo hiciera, no te obligaría.

  • El artículo 40 anula toda estipulación que implique renuncia o disminución de un derecho

que esta ley te reconoce.

  • El artículo 76 obliga a interpretar a tu favor cualquier condición general ambigua u

oscura de un contrato de adhesión.

  • El artículo 38 hace que nuestra publicidad y ofertas al público formen parte del contrato, de modo que lo que publicamos y te mostramos nos obliga.

Puedes presentar tu reclamo ante ACODECO, la Autoridad de Protección al Consumidor y Defensa de la Competencia, y nada aquí lo impide ni te obliga a acudir a arbitraje en su lugar.

Cancela desde los controles de tu cuenta de Coastly. Para una consulta de facturación o el reembolso de un cargo de Coastly, escribe a support@coastly.surf con el correo de tu cuenta y el cargo en cuestión. Para cualquier tema sobre tus datos personales, escribe a privacy@coastly.surf.

Respondemos dentro del plazo que permita la ley de tu país y, en todo caso, sin demora indebida.

What this policy covers

Coastly is a software platform. Coastly only ever charges Vendors, and only these payments are covered here:

  • Coastly Pro, our optional monthly software subscription for Vendors.
  • Featured and promotion placements bought by Vendors.

What is not covered: anything you buy from a Vendor, including the accommodation itself, food, tours, rentals and tickets. You pay the Vendor directly for those and Coastly is not the seller. Contact the Vendor for a refund of their goods or services.

Stays

Coastly charges you nothing when you book a stay. You book and pay the host, either on the host's own booking page or directly with the host. That money never reaches Coastly, so Coastly has nothing to refund. The host's cancellation and refund terms govern the stay, and any refund is the host's to make. Coastly is paid by the host, out of the host's own money, and nothing Coastly earns is added to your price.

Your rights under Panamanian law

This policy is governed by the laws of the Republic of Panama and does not limit any right Ley 45 de 2007 gives you. Where this policy and that law differ, the law wins.

Panamanian law does not give you a general cooling-off right for an online booking. Ley 45 contains no *derecho de retracto*. We say so plainly rather than imply a right you do not have. The commitments above are ours by contract, and we are bound by them.

What Ley 45 does give you, and what we cannot take away:

  • Art. 74 makes a clause of an adhesion contract absolutely null if it limits our liability

for breach or delay, restricts your rights, makes you waive a right in advance, waives your procedural rights, is illegible, or is written in a language other than Spanish. Nothing in this policy is intended to do any of those things, and to the extent anything did, it would not bind you.

  • Art. 40 makes null any term by which you give up or reduce a right this law gives you.
  • Art. 76 requires any ambiguous term in an adhesion contract to be read in your favour.
  • Art. 38 makes our advertising and public offers part of the contract, so what we publish and show you binds us.

You may complain to ACODECO, the Autoridad de Protección al Consumidor y Defensa de la Competencia, and nothing here prevents that or requires you to arbitrate instead.

How to ask

Cancel from the controls in your Coastly account. For a billing question or a refund of a Coastly charge, email support@coastly.surf with your account email and the charge in question. For anything about your personal data, email privacy@coastly.surf.

We answer within the time the law of your country allows, and in any event without undue delay.
